Please Read Before Enrolling
These Terms & Conditions govern your use of OregonDrive.com and your registration, payment, access, and participation in the Oregon Drive online Distracted Driving Avoidance Course. By registering for the course, submitting payment, accessing the course, or otherwise using our services, you acknowledge that you have read, understood, and agree to these Terms.
Oregon Drive provides an educational course. Eligibility for a particular court benefit and acceptance of a completion certificate are determined by applicable Oregon law and the court handling your citation. Students should follow all instructions issued by their court.
Agreement to These Terms
These Terms & Conditions constitute an agreement between you and Oregon Drive concerning your use of this website and the services offered through it.
By using the website, registering for a course, checking an acceptance box, submitting payment, or accessing course materials, you agree to be bound by these Terms and all applicable laws and regulations.
If you do not agree with these Terms, you should not register for or access the course.
Oregon Drive and Course Approval
Oregon Drive offers an online Oregon Distracted Driving Avoidance Course (DDAC) approved for this purpose by the Oregon Department of Transportation Transportation Safety Office.
Oregon Drive is an independent course provider. OregonDrive.com is not an Oregon state government website, court website, or law-enforcement website.
Approval of the course does not mean that Oregon Drive controls a court's decision regarding a citation, fine, sentence, or other legal matter.
Course Eligibility and Court Requirements
Under Oregon's Distracted Driving Avoidance Course program, the course may be available for a person's first conviction of driving a motor vehicle while using a mobile electronic device, subject to applicable law and court requirements.
A judge or court determines whether the course may be used in connection with your citation and whether any fine may be suspended. Oregon Drive does not make that determination.
Students are responsible for confirming their eligibility with the court or agency handling their citation before enrolling.
When applicable, the course generally must be completed within 120 days of sentencing. You remain responsible for complying with any deadline or instruction issued specifically by your court.
The DDAC is not a diversion program. Completion of the course does not remove the violation from your driving record.
Course Completion Requirements
To successfully complete the Oregon Drive Distracted Driving Avoidance Course, a student must satisfy all applicable instructional and assessment requirements.
Students may not skip required instructional content, falsely represent course participation, or attempt to circumvent required timers, assessments, or completion controls.
Registration Information
You agree to provide complete and accurate information when registering for the course. This may include your name, contact information, and other information reasonably required to administer your enrollment and course completion.
Information submitted for your registration and certificate should match the information that must be provided to your court or other appropriate authority.
Oregon Drive is not responsible for delays, rejected documentation, or other problems resulting from inaccurate information supplied by the student.
Course Fees, Payment and Refund Policy
The applicable course fee is displayed on the registration page before payment is submitted. Payment must be successfully processed before course access is activated.
Refund Policy
Because online course access and educational materials are made available following enrollment, course registrations are final and non-refundable once registration and payment have been submitted, except where a refund is required by applicable law.
If you believe you were charged more than once for the same registration or there was a payment-processing error, please contact Oregon Drive promptly so the transaction can be reviewed.
A student's later determination that the student was not eligible for a court benefit does not, by itself, create a right to a refund. Students are responsible for confirming eligibility before registration.
Course Access and Expiration
Course access is provided electronically. Unless a different access period is expressly stated during registration, course access is generally available for 30 days from the date of registration.
Students should not wait until a court deadline is approaching before beginning or completing the course.
Expiration of course access does not extend a court deadline and does not obligate Oregon Drive to reopen or extend an enrollment.
Certificate of Completion
After a student successfully satisfies the course requirements, Oregon Drive will make a Certificate of Completion available at no additional course-certificate charge.
A certificate may only be issued after all required course elements have been successfully completed.
The student is responsible for following any instructions regarding submission of the certificate to the court, unless Oregon Drive specifically states that another submission process applies.
Student Responsibility and Course Integrity
Course registration is intended for the individual student identified in the enrollment information.
Students agree to personally complete all required instructional content and assessments and not permit another person to complete the course on their behalf.
Fraudulent activity, misrepresentation, attempted circumvention of course requirements, or unauthorized use of course materials may result in suspension or termination of access and may prevent issuance of a certificate.
Account and Login Security
You are responsible for maintaining the confidentiality of your course login information and for activity occurring through your account.
You should not share your username, password, login link, or other account-access information with another person.
If you believe your account has been accessed without authorization, please contact Oregon Drive promptly.
Electronic Communications
By registering for or using the course, you consent to receive communications reasonably necessary to administer your enrollment, payment, course access, completion, certificate, and customer-support requests.
Such communications may be provided by email, telephone, or text message using the contact information you provide, as appropriate.
This consent relates to course and service-related communications. Promotional or marketing communications, where applicable, remain subject to any separate consent required by law.
Copyright and Intellectual Property
The Oregon Drive website, course curriculum, lessons, text, graphics, layouts, videos, assessments, trademarks, logos, downloadable materials, and other proprietary content are protected by applicable intellectual-property laws.
Course access provides you with a limited, personal, non-exclusive, non-transferable right to use the materials solely for your individual educational participation in the course.
Without prior written permission, you may not reproduce, copy, publish, distribute, sell, resell, transmit, record, scrape, modify, create derivative works from, or commercially exploit Oregon Drive course materials.
Privacy and Personal Information
Oregon Drive collects and uses information reasonably necessary to operate the website, process enrollment and payment, provide course access, administer completion requirements, issue certificates, provide customer support, and satisfy applicable legal or regulatory requirements.
Additional information concerning the handling of personal information is provided in the Oregon Drive Privacy Policy.
Website and Course Availability
Oregon Drive works to maintain reliable access to its website and course services. However, temporary interruptions may occur because of maintenance, hosting problems, Internet connectivity, security events, third-party services, system upgrades, or circumstances beyond our reasonable control.
Oregon Drive may update or modify website features, course presentation, technology, or administrative procedures when reasonably necessary, provided required course standards continue to be satisfied.
Legal and Court Disclaimer
Oregon Drive provides driver-safety education and related course administration. Oregon Drive does not provide legal advice and does not represent students before a court, government agency, or law-enforcement agency.
Enrollment or successful completion does not guarantee that a court will waive or suspend a particular fine, change a sentence, dismiss a citation, alter a driving record, or provide any other specific legal outcome.
Questions regarding your citation, conviction, court deadline, fine, or eligibility should be directed to the court or agency handling your matter.
Limitation of Liability
To the fullest extent permitted by applicable law, Oregon Drive will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the website or course.
Oregon Drive is not responsible for a student's failure to comply with court instructions, deadlines, eligibility requirements, or submission requirements.
Nothing in these Terms excludes or limits a right or liability that cannot lawfully be excluded or limited.
Governing Law and Severability
These Terms are governed by applicable federal law and the laws of the State of Oregon, without regard to conflict-of-law principles to the extent legally permissible.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Failure to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or any other provision.
Changes to These Terms and Contact
Oregon Drive may update these Terms when reasonably necessary to reflect changes in law, regulation, course requirements, technology, payment practices, or business operations.
Material updates will be reflected by changing the Last Updated date shown at the top of this page. Updated Terms apply prospectively from their effective date unless applicable law requires otherwise.
Questions about these Terms or your course enrollment may be submitted through the Oregon Drive Contact page.
